Dispute Resolution Process

The Executive Board may receive, investigate, attempt to resolve, hold hearings on and impose sanctions arising out of violations of the provisions of the Declaration, the Bylaws and/or Rules and Regulations, and/or complaints and disputes regarding same. 

The Executive Board may request a written and signed Complaint Form (provided by Management), and may present same to the building management who may then attempt informally to resolve the dispute in a fair and equitable manner. 

In the case of a violation or an unresolved dispute, the Executive Board shall give notice of a hearing to be held at which the party or parties may appear and be heard. Notice of the hearing date and time shall be mailed to the record address of any non-resident owner. 

In most cases the Executive Board shall issue sanctions for violations as follows:

1st Violation - Reprimand/Warning

2nd Violation - $150 Fine

3rd Violation - $200 Fine

4th Violation - $250 Fine

5th Violation - $500 Fine

The Executive Board may also levy a fine higher than provided above, and may also, in proper case, require a repeat offender to deposit with the Association a security deposit of up to $1000 to protect the Association and its members against future violations. 

An Aggrieved unit owner, mortgagee or occupant must first request the resolutions of a complaint or dispute under these rules before seeking redress in a court of law.
